At XK Family Law Solicitors Aberdeen, we help clients across Scotland deal with aliment – legal financial support after separation.
🔁 Can an Aliment Order Be Changed?
Yes. A court can change (vary) or cancel (recall) an existing decree of aliment if something important in your circumstances has changed since the original court decision.
💼 Examples of “Material Change in Circumstances”:
- One party’s income increases or decreases.
- Someone loses a job or retires.
- A child maintenance assessment is issued by the Child Maintenance Service (CMS) — this is automatically considered a material change.
✅ Either party can apply to the court to review the aliment amount.
🕒 Can the Court Backdate the Change?
Yes. The court may:
- Backdate the new decision to when the situation changed
- Order refunds if too much was paid before the change
💷 What Is Interim Aliment?
Interim aliment is temporary financial support awarded while the case is ongoing – before a final decision is made.
👥 Who Can Apply for Interim Aliment?
Anyone who has a right to aliment as part of an aliment claim or in a divorce, separation, or civil partnership dissolution action.
You can apply for yourself or on behalf of a child or someone you’re legally entitled to represent.
⚖️ What Can the Court Do?
The court can:
- Order the full amount of interim aliment requested
- Order a reduced amount
- Refuse interim aliment altogether
🕰️ Interim payments usually last until the case is finalised or the court sets an earlier end date.
🔁 Can Interim Aliment Be Changed?
Yes. Interim Aliment awards:
- Can be varied (changed)
- Can be recalled (cancelled)
